This document is not filed (not accessible later), is concluded exclusively in electronic form, does not qualify as a written contract, is written in Hungarian, and does not refer to any code of conduct. For questions regarding the webshop's operation, ordering, and delivery process, we are available at the contact details provided. The scope of these GTCs extends to legal relations on the Service Provider's website (www.klnd.eu) and its subdomains. These GTCs are continuously available on the following website: www.klnd.eu

2. Fundamental Provisions
2.1. Applicable Legislation (Updated)
The Contract is governed particularly by the following laws and regulations:

Regulation (EU) 2016/679 (General Data Protection Regulation - GDPR);

Act CLV of 1997 on Consumer Protection;

Act CVIII of 2001 on certain aspects of electronic commerce services and information society services;

Act V of 2013 on the Civil Code (PTK);

Government Decree 151/2003. (IX. 22.) on the mandatory warranty for certain durable consumer goods;

Government Decree 45/2014 (II.26) on the detailed rules of contracts between consumers and businesses;

NGM Decree 19/2014. (IV. 29.) on the procedural rules for handling warranty and guarantee claims concerning goods sold under a contract between a consumer and a business.
2.2. Modifiability of the Regulations

The Service Provider reserves the right to modify the regulations.
2.3. Copyright and Content Use

The Service Provider reserves all rights regarding the website, any detail thereof, the content appearing thereon, and the distribution of the website. It is prohibited to download, electronically store, process, or sell the content appearing on the website or any detail thereof without the Service Provider's written consent.
3. Registration/Purchase

Guest Checkout: Purchasing in the webshop is not mandatory to a registered account. To purchase using guest checkout, the buyer's name, address, email address, and phone number must be provided for order fulfillment.

User Account Registration: A permanent user account may be created during the checkout process or separately. A user account allows the customer to securely store their login information, address details, and view their order history for future purchases.
4. Scope of Products and Services Available for Purchase

Our webshop sells the Sports Association's own promotional products and registrations for our own organized events.
5. Ordering Process
5.1. Placing an Order

Ordering always begins in the webshop. After selecting the product or event, the required data (name, address, email, phone number) must be provided, and the order must be confirmed. After confirmation, an acknowledgement of the purchase is sent.
5.1.1. Payment Methods

Payment methods:

Bank Transfer: The product price must be transferred within 2 business days to the bank account number displayed at the end of the ordering process and in the confirmation email.

Online Card Payment: Payment via bank card (e.g., Visa, Mastercard) is executed through a secure third-party Payment Service Provider (PSP) (Shopify Payments), which is integrated with the Shopify platform. The Service Provider does not store card details; these are processed solely by the PSP in compliance with industry security standards.

Domestic shipping costs are calculated according to the shipping calculation available on the website.
5.2. Order Confirmation
We send an electronic confirmation message regarding the order and issue an electronic invoice immediately after the transfer/payment processing.
6. Processing and Fulfillment of Orders

Orders are processed on weekdays between 08:00 and 16:00. Orders placed outside these times will be processed on the following business day.
7. Right of Withdrawal
-
In accordance with Directive 2011/83/EU and Government Decree 45/2014. (II.26.), the Consumer may withdraw from the contract without giving a reason and return the ordered product within 14 days of receiving the ordered product.

In the absence of this information notice, the Consumer is entitled to exercise the right of withdrawal up to 1 year. If the Service Provider provides the information after the 14-day deadline from the day of receipt of the product or conclusion of the contract, but within 12 months, the deadline for withdrawal is 14 days from the date of providing this information.
8. Guarantee, Warranty
Statutory Warranty (Kellékszavatosság)

8.1. Claim Eligibility: In the event of defective performance, the User may enforce a statutory warranty claim against the Service Provider according to the rules of the Civil Code.

8.2. User Rights: The User may request repair or replacement, unless the chosen remedy is impossible or disproportionately costly for the business. If repair/replacement is not requested or possible, the User may demand a proportional price reduction, repair the defect at the business's expense, or—as a final resort—withdraw from the contract.

8.3. Deadline: The User (if considered a consumer) must notify the defect immediately, but no later than two months from discovery. The statutory warranty rights cannot be enforced beyond the two-year (1 year in the case of a business) limitation period from the date of performance.

8.4. Enforcement: The claim can be enforced against the Service Provider.

8.5. Proof (Consumer): Within six months from performance, the User only needs to notify the defect and prove the purchase. After six months, the User must prove that the defect already existed at the time of performance.
Product Warranty (Termékszavatosság)

8.6. Claim Eligibility: In the event of a defect in a movable asset, the User may choose between statutory warranty or product warranty.

8.7. User Rights: The User may only request the repair or replacement of the defective product.

8.8. Defective Product: A product is defective if it does not meet quality requirements or lacks the properties specified by the manufacturer.

8.9. Deadline: The User may enforce a product warranty claim within two years (1 year in the case of a business) from the product's placement on the market by the manufacturer.

8.10. Enforcement: The claim can only be enforced against the manufacturer or distributor of the movable asset. The User must prove the product defect.

8.11. Manufacturer Exemption: The manufacturer is exempt if they prove one of the following: the product was not marketed within their business activity, the defect was not scientifically recognizable at the time of marketing, or the defect resulted from legal/official regulation.

Note: You cannot enforce statutory warranty and product warranty claims simultaneously for the same defect.
Mandatory Guarantee (Jótállás)

This applies to certain durable consumer goods listed in Government Decree 151/2003 (IX. 22.). If the products sold by the Service Provider fall under this regulation (e.g., items over 10,000 HUF with a long expected lifespan), the mandatory guarantee period is enforced.
9. Procedure in Case of Warranty Claims

9.1. Non-Derogation: In a contract between a consumer and a business, the agreement may not deviate from the regulations to the detriment of the consumer.

10. Miscellaneous Provisions
10.1. Jurisdiction and Alternative Dispute Resolution
Contact details for the geographically competent Conciliation Bodies (Békéltető Testületek) in Hungary are provided below. These bodies are available for the out-of-court settlement of consumer disputes.

11. Complaint Handling Procedure (For Users Classified as Consumers)
11.1. Submitting Complaints

Procedure and Recording

Verbal Complaints: Must be immediately examined and, if necessary, remedied. If the consumer disagrees or immediate investigation is not possible, a record (jegyzőkönyv) must be drawn up immediately. For verbal complaints by phone or electronically, the record must be sent to the consumer within 30 days along with the substantive reply.

Written Complaints: Must be substantively answered in writing and communicated to the consumer within 30 days of receipt (unless a shorter/longer period is set by law). The rejection of a complaint must be justified.

The record must include all necessary details (consumer information, complaint description, time, place, and the Seller's position). The Seller must retain the record and the reply copy for five years.
Legal Remedies for Consumers
If the consumer complaint is rejected, the Seller must inform the consumer in writing about the right to initiate proceedings with the relevant Consumer Protection Authority (District Office / Járási Hivatal) or Conciliation Body.
Available legal remedies:

Complaint to Consumer Protection Authorities: The consumer may turn to the relevant District Office for violations of consumer rights.

Judicial Proceedings: The client is entitled to enforce their claim before a court within the framework of civil procedure.

Conciliation Body (Békéltető Testület): The consumer may turn to the Conciliation Body relevant to their residence or domicile.

The business has a mandatory duty to cooperate in the Conciliation Body procedure. Failure to cooperate may result in mandatory fines imposed by the consumer protection authority.

12. Copyrights
12.1. Copyright Protection of the Webshop

The website is a copyrighted work, and all its parts are protected by copyright (Act LXXVI of 1999 on Copyright).

Unauthorized use of the graphical and software solutions, computer programs, or any application that modifies the website is prohibited.
